David representative ordered back to prison in decentralization funds case

What Happened

The representative of David corregimiento, Jorge Eduardo Montenegro Vallarino, has been ordered back to prison after a higher court revoked his house arrest in a case involving alleged embezzlement tied to funds from the National Decentralization Authority.

The Third Judicial District Court of Appeals in Chiriquí and Bocas del Toro decided that provisional detention is the most appropriate measure while the investigation continues. The ruling came during a hearing held on Wednesday.

Court’s Reasoning

The panel of magistrates, led by Carlos Valentín Rivas Alarcón and joined by Jackeline Montenegro and Carlos Daniel Fajardo Morales, concluded that detention is the most proportionate measure given the nature of the alleged offense and the risk that evidence could be affected.

The court also considered a forensic medical report from the Institute of Legal Medicine and Forensic Sciences, which indicated that Montenegro Vallarino’s health condition can be treated while in detention, with authorization for medical evaluations when necessary.

Background to the Case

The criminal investigation began after the Office of the Comptroller General sent an audit report to the Public Ministry regarding alleged misuse of funds intended for social-interest programs in the David Cabecera community board between 2019 and 2024.

On July 20, 2025, the Anticorruption Prosecutor’s Office sent the National Police investigative directorate a list of 70 former representatives, former treasurers and former mayors who had to be located after the audit uncovered irregularities in the handling of the funds.

Another Defendant in the Same Probe

In the same case, Emgelberth Geovanny Estrada Linares remains under house arrest. He is a board member of the Social Security Fund and served as treasurer of the David community board between 2019 and 2024.

Prosecutors allege that he took part in the irregular handling of decentralization funds assigned to the community board.

What This Means

The ruling keeps the case centered on alleged irregular use of public funds in one of Chiriquí’s most important districts. It also reflects the courts’ willingness to use preventive detention in corruption investigations when judges believe there is a risk to the integrity of the process.
