Panama lawyers denounce Contraloría move in anticorruption probe as overreach

The National Bar Association of Panama sharply criticized the Comptroller General’s Office after its officials entered anticorruption prosecution proceedings tied to an investigation involving former vice president José Gabriel Carrizo. The bar association described the move as a “grave overreach of functions” and warned that it could undermine the integrity of the case.

According to the guild, the intervention lacked legal basis, endangered the validity of evidence and jeopardized due process. The criticism came after the Public Prosecutor’s Office said it had opened a criminal investigation following a complaint that Comptroller’s Office officials interrupted an interview session with auditors in a case handled by anticorruption prosecutors.

Why the Reaction Matters

The bar association said the incident raises broader concerns about institutional boundaries in Panama’s justice system. In its view, allowing one state body to interfere in an active prosecutorial proceeding weakens the separation of powers and creates a dangerous precedent for judicial independence.

Those concerns are especially sensitive in corruption cases, where public confidence depends on investigative procedures being carried out without interference. The association argued that respect for constitutional order is a duty of public servants and called for an immediate end to these practices.

The Investigation at the Center of the Dispute

The prosecutors’ office said the matter involves a case for unjustified enrichment linked to Carrizo, who served as vice president of the Republic of Panama. Prosecutors said auditors from the Comptroller’s Office were being interviewed as part of that investigation when the disruption occurred.

The images fueled public attention around the confrontation between the two institutions and prompted wider debate over the limits of oversight powers during criminal proceedings.

The clash underscores a recurring issue in Panamanian public life: the balance between oversight institutions and prosecutorial independence. The Comptroller’s Office has an important role in auditing public funds, while the Public Prosecutor’s Office is responsible for criminal investigations. When those functions overlap, disputes over authority can quickly become constitutional questions.
